How to Clear ECB Violations

Have you recently received an order to clear ECB violations in your rental? If you have, you probably understand the dread of reading the top line – Commissioner’s Order to Correct Violation Conditions. That yellow piece of paper means that something in your tenant building violates the NYC building codes. The Differences Between ECB and OATH

The acronyms ECB and OATH are often used interchangeable, but in practice, they essentially mean the same thing. You have a building violation that needs to be corrected as soon as possible.

  • ECB – Environmental Control Board
  • OATH – Office for Administrative Trials and Hearings

You must correct the hazardous conditions. However, you may or may not have to attend a hearing. It’s best to look at your notice. If the Must Appear box is checked or you are contesting the violation, you must appear at the hearing or send someone in your place to contest the violation.

Understanding the Most Serious OATH Violations

Not all OATH violations are the same, and the degree of hazard associated with your violation will determine the timeframe. Some violations are given as long as 30 days to be corrected, but the most serious violations are only given 24 hours. 

The most serious OATH violation is a Class 1. These violations are immediately hazardous, meaning someone could get seriously injured when occupying that area. If these violations are not corrected by the correction date, it can result in high fines.

How to Clear OATH Violations

Clearing OATH violations is a three step process.

1. Read your notice to determine what needs to be corrected.

2. Hire the appropriate contractors. If it’s a plumbing violation, you‘ll need to hire a licensed master plumber that is experienced in clearing OATH violations.

3. John will submit the documents necessary to correct the violations and the Homeowner can notarize the Certification of Correction at the end of a job.
